These Terms of Service (“Terms”) govern your use of vulcinity.com and purchases from Vulcinity (“Vulcinity,” “we,” “us,” or “our”). By accessing the site, creating an account, or placing an order, you agree to these Terms and the policies linked below. If you do not agree, do not use the Services.
1. Eligibility and Accounts
You must be able to form a legally binding contract in your jurisdiction to use the Services. If you create an account, you are responsible for accurate information, maintaining the confidentiality of your credentials, and activity under your account. Notify us promptly of suspected unauthorized use.
2. Store Terms
You may not use our products or Services for an unlawful or unauthorized purpose. You may not transmit malware, interfere with the operation or security of the site, misuse another person’s information, or violate applicable law.
3. Products, Availability, and Display
We try to describe and display products accurately, including color, size, materials, and condition. Screens and photography can affect appearance. Product information, pricing, and availability may change without notice. We may limit quantities, discontinue products, or correct errors.
4. Orders and Acceptance
Submitting an order is an offer to purchase. An order confirmation acknowledges receipt but does not guarantee acceptance. We may refuse or cancel an order for reasons including suspected fraud, automated abuse, inventory errors, pricing errors, payment problems, shipping restrictions, or violations of these Terms. If we cancel after payment, we will issue an appropriate refund to the original payment method.
5. Prices, Payments, and Taxes
Prices are shown in the currency indicated on the site and may change without notice. You agree to provide current, complete, and accurate billing information. Applicable taxes, shipping charges, duties, and fees are shown or calculated as required. Payment processing is provided by third parties and may be subject to their terms.
6. Shipping and Delivery
Processing times, shipping rates, delivery estimates, tracking, international charges, and delayed-package procedures are described in our Shipping Policy. Delivery dates are estimates unless expressly stated otherwise. Risk of loss and title pass as provided by applicable law and the carrier’s terms.
7. Returns and Refunds
Returns, exchanges, damaged-item claims, exclusions, and refund timing are governed by our Refund Policy.
8. Promotions and Discount Codes
Promotions and discount codes are subject to their stated terms, expiration dates, eligibility rules, product exclusions, and usage limits. Unless expressly permitted, offers cannot be combined, exchanged for cash, sold, transferred, or applied retroactively. We may cancel a promotion or reject use caused by error, fraud, or automated abuse.
9. Reviews, Photos, and Other Submissions
If you submit a review, photo, video, testimonial, tag, comment, or other content (“User Content”), you represent that you own it or have permission to submit it and that it does not violate another person’s rights or applicable law. You retain ownership of your User Content.
You grant Vulcinity a non-exclusive, worldwide, royalty-free, sublicensable license to host, reproduce, adapt, publish, display, distribute, and use submitted User Content to operate, market, and improve Vulcinity, subject to applicable law and our Privacy Policy. You may contact us to request that we stop using future displays of your User Content, although previously produced materials may not always be retractable.
10. Intellectual Property
The site and its content—including Vulcinity branding, text, graphics, photographs, designs, layout, and software—are owned by or licensed to Vulcinity and protected by intellectual-property laws. Except as allowed by law, you may not copy, modify, distribute, sell, license, or exploit site content without written permission.
11. Automated Access and Prohibited Conduct
You may not use bots, scripts, crawlers, scraping tools, automated checkout attempts, fake identities, disposable or unauthorized contact information, or other means to disrupt the Services, reserve inventory improperly, collect data, abuse promotions, or generate fraudulent activity. We may block traffic, cancel orders, restrict access, and preserve relevant records to protect the Services and our customers.
12. Third-Party Services and Links
The Services may use or link to third-party platforms, applications, payment providers, carriers, and websites. We are not responsible for third-party content or practices. Your use of a third-party service may be governed by separate terms and privacy policies.

14. Disclaimers
To the fullest extent permitted by law, the Services and site content are provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement, except where a disclaimer is not permitted. Nothing in these Terms limits any warranty or consumer right that cannot legally be excluded.
15. Limitation of Liability
To the fullest extent permitted by law, Vulcinity and its owners, employees, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, revenue, data, or goodwill arising from the Services. Where liability cannot be excluded, our aggregate liability will not exceed the amount you paid to Vulcinity for the transaction giving rise to the claim. These limits do not apply where prohibited by law.
16. Indemnification
To the extent permitted by law, you agree to indemnify and hold Vulcinity and its affiliates, owners, employees, and service providers harmless from third-party claims, liabilities, damages, and reasonable costs arising from your unlawful use of the Services, your violation of these Terms, or your infringement of another person’s rights.
17. Governing Law
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law rules, except where the laws of your place of residence provide mandatory consumer protections. Any dispute may be brought in a court with lawful jurisdiction. We do not require arbitration or waive class-action rights through these Terms.
18. Severability and Waiver
If a provision is found unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver.
19. Termination
We may suspend or terminate access to the Services when reasonably necessary to address fraud, abuse, security risks, legal requirements, or violations of these Terms. Provisions that by their nature should survive termination will survive.
20. Changes to These Terms
We may update these Terms by posting a revised version and changing the “Last updated” date. Material changes apply prospectively unless law requires otherwise. Continued use after changes take effect constitutes acceptance where permitted by law.
